1. GENERAL PROVISIONS

These Terms and Conditions set forth the rules and regulations under which sole proprietorship Ivan Vasiljević pr Prerada čaja i kafe 7AM Coffee Roastery Beograd (hereinafter referred to as: the "Merchant") provides online sales services through the online store located at domain www.7am.rs (hereinafter referred to as: the "Webshop"). These Terms and Conditions are binding upon all users and buyers. Please read them carefully before making a purchase.

By using the Webshop or confirming an order, the buyer acknowledges that they are familiar with these Terms and Conditions and accept them in full.

2. PRICES AND VAT STATEMENT

All product prices displayed on the Webshop are expressed in Serbian Dinars (RSD). VAT is included in the stated prices and there are no hidden costs. The Merchant reserves the right to change prices at any time, provided that such changes will not affect orders that have already been confirmed.

3. CURRENCY CONVERSION STATEMENT

All payments will be effected in Serbian currency – Dinar (RSD). The middle exchange rate of the National Bank of Serbia is used for informative display of prices in other currencies. The amount charged to your credit/debit card account will be expressed in your local currency through conversion into RSD at the exchange rate used by payment card schemes, which cannot be known to us at the time of the transaction. As a result of this conversion, there is a possibility of a slight difference from the original price listed on our website.

4. PAYMENT METHODS

The buyer can pay for products purchased on the Webshop via the following payment methods:

  • Online Payment Cards: DinaCard, Visa, MasterCard, Maestro, and American Express payment cards issued by domestic and foreign banks. Processing is executed in real-time through the Banca Intesa ad Beograd acquiring gateway.
  • Cash on Delivery (COD): Cash payment upon handover of the shipment by the courier service.

5. PROTECTION OF CONFIDENTIAL TRANSACTION DATA

When entering payment card data, confidential information is transmitted via public network in a protected (encrypted) form using SSL protocol and PKI system, as currently the most advanced cryptographic technology. Security of data during purchase is guaranteed by the payment card processor, Banca Intesa ad Beograd, so the entire payment process is conducted on the bank's website. At no time is card data accessible to our system.

6. DELIVERY OF GOODS AND RESTRICTIONS

Delivery of ordered products is carried out via an engaged courier service exclusively within the territory of the Republic of Serbia. Delivery outside the borders of the Republic of Serbia is currently not available.

  • Shipment Processing: To ensure maximum freshness of roasted coffee, shipments are handed over to the courier service as soon as possible after order confirmation.
  • Delivery Costs: Delivery fees are calculated according to the current courier price list and are clearly shown in the shopping cart before final order confirmation.

7. RIGHT OF WITHDRAWAL AND RETURN POLICY

In accordance with the Law on Consumer Protection of the Republic of Serbia, the buyer has the right to withdraw from the contract concluded at a distance within 14 (fourteen) days from the date the goods are delivered, without stating reasons and without additional costs, except for the direct costs of returning the goods.

Exceptions to the Right of Withdrawal: In accordance with Article 37 of the Consumer Protection Law, the right of withdrawal does not apply to goods subject to rapid deterioration or expiration (opened and unsealed packages of roasted coffee), as well as sealed goods not suitable for return due to health protection or hygiene reasons if unsealed after delivery.

For unopened packages of coffee, equipment, and accessories, the buyer may exercise their right of withdrawal by sending a notification via e-mail to: coffee@7am.rs.

8. COMPLAINTS AND RECOURSE PROCEDURE

The buyer has the right to file a complaint in case of non-conformity of goods, damage during transport, incorrect items delivered, or incorrectly calculated prices.

  • Filing a Complaint: Complaints are submitted by sending an e-mail to coffee@7am.rs including the order number, detailed description of the issue, and photos of damage/non-conformity.
  • Response Timelines: The Merchant will confirm receipt of the complaint and deliver an official response within 8 days. The final decision/resolution will be implemented within 15 days of receipt.
  • Return Shipping Costs: If the complaint is deemed justified, all transport costs for return or replacement of goods shall be borne by the Merchant.

9. REFUND POLICY

In case of returning goods and refunding funds to a customer who previously paid with one of the payment cards, partially or in full, regardless of the reason for return, Ivan Vasiljević pr Prerada čaja i kafe 7AM Coffee Roastery Beograd is obliged to execute the refund exclusively through VISA, EC/MC, Maestro, Amex, and Dina payment methods, which means that the bank will, at the request of the seller, perform the refund to the account of the cardholder.

10. USER PRIVACY PROTECTION

On behalf of Ivan Vasiljević pr Prerada čaja i kafe 7AM Coffee Roastery Beograd, we commit to preserving the privacy of all our customers. We collect only necessary, basic customer/user data required for business operations and customer notification in accordance with good business practices and in order to provide quality service. Customers are given the choice including the decision whether or not they want to be deleted from mailing lists used for marketing campaigns. All customer data is strictly stored and accessible only to employees who require such data to perform their duties. All employees of 7AM (and business partners) are responsible for adhering to privacy protection principles.

11. FINAL PROVISIONS

These Terms and Conditions come into force on the date of publication on the website www.7am.rs. The Merchant reserves the right to amend these Terms in accordance with changes in legal regulations or business policies, with the obligation to publish the updated text on the Webshop.

1. OSNOVNE ODREDBE

Ovim Uslovima korišćenja utvrđuju se pravila i uslovi pod kojima preduzetnik Ivan Vasiljević pr Prerada čaja i kafe 7AM Coffee Roastery Beograd (u daljem tekstu: "Trgovac") pruža usluge prodaje robe putem internet prodavnice na domenu www.7am.rs (u daljem tekstu: "Webshop"). Uslovi korišćenja obavezujući su za sve korisnike i kupce. Molimo Vas da ih pažljivo pročitate pre obavljanja kupovine.

Korišćenjem Webshop-a ili potvrdom porudžbine, kupac potvrđuje da je upoznat sa ovim Uslovima i da ih u potpunosti prihvata.

2. CENE I IZJAVA O PDV-U

Sve cene proizvoda navedene na Webshop-u izražene su u srpskim dinarima (RSD). PDV je uračunat u istaknute cene i nema skrivenih troškova. Trgovac zadržava pravo promene cena u bilo kom trenutku, s tim da se promena ne odnosi na već potvrđene porudžbine.

3. IZJAVA O KONVERZIJI

Sva plaćanja biće izvršena u lokalnoj valuti Republike Srbije – dinar (RSD). Za informativni prikaz cena u drugim valutama koristi se srednji kurs Narodne Banke Srbije. Iznos za koji će biti zadužena Vaša platna kartica biće izražen u Vašoj lokalnoj valuti kroz konverziju u istu po kursu koji koriste kartičarske organizacije, a koji nama u trenutku transakcije ne može biti poznat. Kao rezultat ove konverzije postoji mogućnost neznatne razlike od originalne cene navedene na našem sajtu.

4. NAČIN PLAĆANJA

Kupac proizvode kupljene na Webshop-u može platiti na sledeće načine:

  • Platnim karticama (Online): DinaCard, Visa, MasterCard, Maestro i American Express karticama izdatim od strane domaćih i stranih banaka. Plaćanje se izvršava u realnom vremenu putem prihvatnog mesta Banca Intesa ad Beograd.
  • Plaćanje pouzećem: Gotovinski prilikom preuzimanja pošiljke od kurirske službe.

5. ZAŠTITA POVERLJIVIH PODATAKA O TRANSAKCIJI 

Prilikom unošenja podataka o platnoj kartici, poverljive informacija se prenose putem javne mreže u zaštićenoj (kriptovanoj) formi upotrebom SSL protokola i PKI sistema, kao trenutno najsavremenije kriptografske tehnologije. Sigurnost podataka prilikom kupovine, garantuje procesor platnih kartica, Banca Intesa ad Beograd, pa se tako kompletni proces naplate obavlja na stranicama banke. Niti jednog trenutka podaci o platnoj kartici nisu dostupni našem sistemu.

6. DOSTAVA ROBE I OGRANIČENJA

Dostava naručenih proizvoda vrši se putem angažovane kurirske službe na teritoriji Republike Srbije. Isporuka je moguća isključivo na teritoriji Republike Srbije. Trgovac trenutno ne vrši isporuke van granica zemlje.

  • Slanje pošiljki: Radi očuvanja maksimalne svežine pržene kafe, pošiljke se predaju kurirskoj službi u najkraćem roku nakon prijema porudžbine.
  • Troškovi dostave: Trošak dostave obračunava se po važećem cenovniku kurirske službe i jasno je prikazan u korpi pre finalne potvrde kupovine.

7. ODUSTANAK OD UGOVORA I PRAVO NA POVRAT (PRAVO NA JEDNOSTRANI RASKID)

U skladu sa Zakonom o zaštiti potrošača, kupac ima pravo da odustane od ugovora zaključenog na daljinu u roku od 14 (četrnaest) dana od dana kada mu je roba predata u državinu, bez navođenja razloga i dodatnih troškova, osim direktnih troškova vraćanja robe.

Izuzeci od prava na odustanak: U skladu sa članom 37. Zakona o zaštiti potrošača, pravo na odustanak ne primenjuje se na robu koja je podložna pokvarenosti ili joj brzo ističe rok trajanja (otvorena i otpečaćena pakovanja pržene kafe), kao i na zapečaćenu robu koja nije pogodna za vraćanje iz razloga zaštite zdravlja ili higijenskih razloga ukoliko je otpečaćena nakon isporuke.

Za neotvorena pakovanja kafe, opremu i pribor, kupac ostvaruje pravo na odustanak slanjem obaveštenja na e-mail: coffee@7am.rs.

8. REKLAMACIJE I PROCES REŠAVANJA

Kupac ima pravo na podnošenje reklamacije u slučaju nesaobraznosti robe, oštećenja pri transportu, pogrešno isporučene robe ili pogrešno obračunate cene.

  • Podnošenje reklamacije: Reklamacija se podnosi slanjem e-maila na coffee@7am.rs uz broj porudžbine, opis problema i fotografije oštećenja.
  • Rokovi postupanja: Trgovac će potvrditi prijem reklamacije i poslati odgovor u roku od 8 dana. Konačno rešenje biće sprovedeno u roku od najviše 15 dana od prijema.
  • Troškovi povrata: Ukoliko se reklamacija utvrdi kao opravdana, sve troškove transporta povrata ili zamene robe snosi Trgovac.

9. POVRAĆAJ SREDSTAVA (OBAVEZNI TEKST BANCA INTESA)

U slučaju vraćanja robe i povraćaja sredstava kupcu koji je prethodno platio nekom od platnih kartica, delimično ili u celosti, a bez obzira na razlog vraćanja, Ivan Vasiljević pr Prerada čaja i kafe 7AM Coffee Roastery Beograd je u obavezi da povraćaj vrši isključivo preko VISA, EC/MC, Maestro, Amex i Dina metoda plaćanja, što znači da će banka na zahtev prodavca obaviti povraćaj sredstava na račun korisnika kartice.

10. ZAŠTITA PRIVATNOSTI KORISNIKA

U ime Ivan Vasiljević pr Prerada čaja i kafe 7AM Coffee Roastery Beograd obavezujemo se da ćemo čuvati privatnost svih naših kupaca. Prikupljamo samo neophodne, osnovne podatke o kupcima/korisnicima i podatke neophodne za poslovanje i informisanje korisnika u skladu sa dobrim poslovnim običajima i u cilju pružanja kvalitetne usluge. Dajemo kupcima mogućnost izbora uključujući mogućnost odluke da li žele ili ne da se izbrišu sa mailing lista koje se koriste za marketinške kampanje. Svi podaci o korisnicima/kupcima se strogo čuvaju i dostupni su samo zaposlenima kojima su ti podaci nužni za obavljanje posla. Svi zaposleni u 7AM (i poslovni partneri) odgovorni su za poštovanje načela zaštite privatnosti.

11. ZAVRŠNE ODREDBE

Ovi Uslovi korišćenja stupaju na snagu danom objavljivanja na internet stranici www.7am.rs. Trgovac zadržava pravo izmene Uslova u skladu sa promenama propisa ili poslovne politike, uz obavezu objavljivanja ažuriranog teksta na Webshop-u.
